No. If you are inside the home and can not see in plain daylight (lights off/dark outside) then you can shoot to kill. You are not required to check to see if the intruder who has broken into your home is aiming at your face with a shotgun before you shoot first. If you are not inside the home at the time, then it is a property crime.
