Its unfortunate the accident happened, but its not the fault of the BMW driver. Had the BMW driver swerved and forced the EVO driver to take the exit ramp thats another story.
I actually know the answer to this. Topic came up in my business law class at mason. So here it is...
If a driver does something that contributes to an accident, even if it was NOT his fault per say, he is guilty. Ex: If driver A is rearended by driver B. A will also be guilty if he was speeding at the time of being rearended.
