Assuming he's got an older Miata without an airbag in the dashboard I don't see the problem. I did it for a while in my old MR2 and even asked a couple officers. They all said the same thing. As long as there's no airbag present (some said it's okay if it can be disabled but wouldn't recommend it as the driver might forget to disable it) then it's not against the law.

Don't get me wrong, I agree that putting the child in the front of the car isn't the safest place but it isn't illegal.
