Default Questions about insurance and a ticket

On wednesday i was driving to work on 460. i came around a blind corner and found a little pontiac laying on its drivers side accoss the road. At this time i was only 100 feet from the car and the roads were wet from rain. I hit my brakes and tried to steer around the car. i lost control and i slammed into the side of the hill hood first. As i hit the hill my truck was still traveling toward the car in the road. My truck flipped up on its drivers side and slid down the road a little ways before flipping back up on the wheels and slamming into the mountain again tailgate first. When this was all said and done i came to a stop about 7 feet from the car.

When the State Police arrived i was cited for "failure to maintain control of a motor vehicle. Does this sound legit? I wouldn't have wrecked if i was not trying to keep from killing the woman in the car on it's side.

My second question is this. How do insurance companies decide if a vehicle is totaled?

Yes..it's a typical ticket that you'll get when you're in an accident that wasn't you fault.

I'd try and fight it.

Make sure you get pictures of the corner

Insurance companies have assessors that determine whether the the cost to repair the vehicle is worth the actual current appraised value of the vehicle. If it is, then it is considered totaled.

yeah thats pretty much standard practice to give that ticket. You should be able to get out of it. It wouldnt hurt if you can get the lady in the other car to come with you to court.
And yeah if repair cost>actual value=totaled

ok a little more background.

the lady that wrecked in front of me was cited for wreckless driving and she has the same court date as me. I will be hiring a lawyer

damage to my truck.... drivers side of vehicle slid down the highway-it's fucked. cab above driver's side is crushed in about 3 inches. both front fenders, hood, and front bumper are seriously crushed in. tailgate and rear bumper will have to be replaced. basically the only sheet metal on the vehicle that is worth fixing is the passenger side doors and passenger side of the bed.

why not? pay the salvage bid and part it out.

I thought about it. I am not sure if it is worth my trouble. I think those salvage bills can be pretty high sometimes. Also i live out in the sticks now so it makes things a little harder to do than when i was living in chesapeake
