maybe the driver "just didn't like Jeeps in general"?

honestly though,i can't see you getting anything more than the value of the damage to the vehicle.people destroy cars all day long due to blatant disregard for the law.this is no different.nobody was hurt......i just don't see a lawsuit holding up.
i'd definitely contact your insurance ASAP.i got a lot of grief from mine when i didn't file after a person hit me.the person that hit me never did file a claim with their company,and it was much harder for me to get things started after i waited a week or so to figure out the offender didn't have any intention of doing so.if this turns into something that goes on your uninsured policy(if they never charge a driver of the truck),you want to be sure you've taken all necesary steps.

With roughly 3 years of insurance and subrogation background, I would be nearly willing to guarantee they will get their money. I wasn't saying they could expect a million dollar settlement, but they will get what they are owed because there is plenty of evidence as to who/what hit and ran.

I have background with commercial liability, and private passenger... Corporate world is handled much different IMO as far as when a vehicle with a corporate logo driven by an employee hits a private passenger vehicle and runs or fails to report the accident. It's different than if Joe Schmoe were hit by an ordinary John Doe drunk driver that hits them and runs like in my situation I went through.

Can the trailer number or truck number be viewed on the tape? If so, their records will show who was driving it... you can pretty much guarantee that driver will be out of a job also... no other transportation company will hire the driver with that on their record either.

Well, here is an update. Apparently the guy driving the truck just can not drive plain and simple. The video they showed Marie the truck was leaving the parking lot and actually ran over a curb behind Marie. That is the video that they thought was where it hit Maries car... well after they looked into it more today they found the actual video where it was hit. The same person in the good will truck. When he was first entering the parking lot is where he hit Maries car and she said you can actually see the jeep move backwards about 3 or 4 feet.

Here is the killer... The driver actually did stop after doing it. He stopped to inspect the damage to his truck and carried on his merry way. So the cameras caught even better evidence... they got a full frontal image of the truck driver and his face is easily visible. I believe the DOT number was visible on the truck as well.

Regardless they do know who did it now. Goodwill is beating around the bush saying that the claim needs to be approved by the CEO of Goodwill before they will submit it to their insurance company. So basically we can't get Marie a rental car, nor will we know anything until Monday.

Marie contacted her insurance company and they bluntly told her that they are only going to do something about it if she pays the dedutable... if we want to have the jeep towed away we will have to pay for it out of our pocket which will not be reimbursable. So they are not helping at all with the situation.

Any costs to you will be reimbursed by goodwill's insurance company. Have it towed.

I don't see where anyone has grounds to sue so far... But you should get your fair share in reinbursement. Give them some pressure and keep it on them. They will settle real fast if you start talking hard.

From the looks of it its structual damage. Which is just as bad as frame. I have been on the phone with 43856748575 different people trying to get this over as quickly as possible..the head of LP usesd to be a cop and is helping everyway he can. I have a contact for Goodwill but she is just the district manager and shes fishy at that..i will be getting th enumber to the CEo and light a fire under his ass and make sure i get paid for the time with out the car, damage, repair and if my frame is bent===NEW CAR...thats ok..im gonna play it their way till tuesday and if nothing is done heads will roll..Oh Adam, i talk to allstate today and they are not gonna do shit for me..so help an asian out

What do you mean??? I thought you were considering going to law school, but you don't understand how anyone has any grounds to sue?

You do understand that a settlement is basically an attempt to pull the blanket over the fire to put it out, right? It's basically an attempt to stay out of court. It would cost Goodwill more to defend theirselves in a courtroom than it would to settle out and make the situation right to where Marie is satisfied. The driver was 100% at fault, and it seems as if he can't deny anything at this point since he got out and inspected the damage and then took off again. There's obviously no question as to whether or not Goodwill is liable, since the vehicle was clearly marked and they've already admitted that they had a driver in the area and know exactly who the guy is.

This is CLEARLY a case that could end up in court if Goodwill doesn't play their cards right. No one is asking for anything unreasonable! She just wants the situation to be corrected. She had a perfectly good Jeep before this asshole ran over it, and I'm sure that's all she expects.



Marie: What do you mean Allstate isn't willing to help you out? Are you telling me their subrogration team isn't even going to fucking help you get the ball rolling????? That's what they fucking do for a living! They pursue other companies and/or insurance companies (and customers) to prevent their own customer from coming out of pocket, essentially.

I predict it may take some time if you don't stay on their ass, but things are going to work out in your favor. Let me know what you want me to do.
