If you read the law carefully there is no provision to allow speeds under 45MPH on an Interstate highway. Maximum speeds of 35MPH or less exclude interstate highways in their descriptions.

If you read the law carefully, there is no provision that prohibits speeds under 45MPH. The law doesn't work the way you suggest...you are permitted to do something unless it is specifically prohibited.
The minimum speed is up to interpretation, and changes based on road conditions as quoted from your source:
Minimum Speed Limit: I. No person shall drive a motor vehicle at such a slow speed as to impede the normal and reasonable movement of traffic. '46.2-877 (&1) II. A person, driving at less than the normal speed of traffic, shall drive in the lane nearest the right edge or right curb of the highway when such lane is available for travel. Hell yea! It is basically a hidden tax increase and in alot of cases the punishment far exceeds the crime. Sure make it tougher on dui offenses but don't rape a person that gets a ticket for rolling thru a stop sign when nothing is coming!
This reminds me of when my school district was charging every student something like $35, for a "usage fee". The thought they could get around it because it wasn't to attend school, only to use the facilities, they got sued and lost.
There are a lot of shady stuff the governments do to try and get away with this stuff, the founding fathers should be rolling in their graves.

The steep fees are intended to raise money for state highway projects. They apply only to Virginians because failure to pay results in a suspended driver's license -- and the state doesn't have any authority to suspend out-of-state licenses.
Defense lawyers already are preparing a court challenge. One possible argument is that the fees exclusive to Virginians violate the equal protection clause of the U-S Constitution.

This happens all the time with new laws. There are certain to be attorneys who will come up with creative arguments as to why a new law is unconstitutional. They will make their arguments in front of a judge who will determine if the law is in fact unconstitutional. We'll just have to wait and see how it plays out in court.
