My brother was drinking at Glory Days and got drunk so his friends put him in his car in his passenger seat with his keys in the cup holder so he can sober up and drive later. The cops came later and ask what he was doing and he replied back saying that he is resting here and trying to sober up.

Then the cop said something like either I could give you a DUI right now or have someone pick you up and take you home. So I had to give my brother a ride at like 3am. I guess they don't allow him to sleep in his car because they scared that he might drive while he is still drunk?

You obviously do not comprehend or understand what a Designated driver is supposed to do.

My post was concerning the people who are innocent or trying to act responsibly and get arrested and convicted. You were caught driving after drinking and are lucky that you got off, or didn't get in a wreck in kill someone.
uh drinking responsibily? there is a reason there is a .08 BAC as the "legal limit"

i've grown up in a family atmosphere were at gatherings people socially drink (responsibly) and get in their cars and drive home with their families.

exactly. he's lucky he didn't have the key in the ignition.

apparently not. dd doesn't mean you can't drink if you're over the age of 21, from my understanding the law allows responsible adults to consume alcohol up to (not at) the legal limit, considering the legal limit doesn't have you toasted (which for some people it would).

you can get a dui at ANY BAC content if you're driving recklessly. in my case the officer had no reason to pull me over except hoping i was underage or drunk, which is exactly what he didn't get. i passed him, saw him. why the fuck wouldn't i come to a complete stop knowing there was a cop behind me on a friday night and i had consumed an alcoholic beverage?

Many consider a Designated Driver one who consumes non alcoholic beverages so they are in the right frame of mind to safely drive those who have consumed alcoholic beverages home.

You can be under the legal limit and still have an accident and possibly kill someone. That kind of degrades the purpose of a designated Driver.

I think he's trying to say that a breathalizer can detect ANY amount of alcohol on your breath, even a beer or two that wouldn't impair you at all.

hence why he campared it to sober driving, because neither involve someone impaired.
