Actually the test is threat of death or serious bodily injury. If someone runs up to me out of nowhere and punches me in the face who is to say that he's going to stop there? If you fell to the ground your head could be stomped with ease. In that situation I would probably shoot the mofo.

That being said... I'll never forget what Ed Morningstar told me in my CCW class.. "I'd rather be judged by 10 than carried by six".
People can speculate all they want about what the law says (threat of death or serious bodily injury is two different definitions to two different people; especially the prosecution/defense), but it's very gray and in the end it's going to be judged by a jury of your peers..

If you can't argue that you felt like your life was in danger in this area, you don't deserve to be breathing. You don't know what the other person intends, only what you believe what they will do. Every single day you turn on the news you hear about a different homicide, not hard to argue in my opinion. Better safe than sorry.

She falsified a police report, wasted the time of 5 police officers on Christmas night, put my wife and I through hell (as well as the rest of her family it's my wife's sister/my sister-in-law) in our own house, and spent 4 days in jail. She's looking at alot of fines and some deep shit.
Her and her husband are probably getting divorced and her kids are a mess. We knew she was an alcoholic but this is where it came to a head.
Needless to say, our Christmas weekend was ruined and she will not be staying with us ever again.
The cops kept questioning her and her story would change a little each time. They went to the Exxon and watched the tapes and did see the dude she described, but he did nothing wrong. They called her out on the lie and she broke down and apologized and what not, but she still went to jail. I wish she were still in jail for all the shit she put us through.
