Illegal Exhaust ticket, what to do?
The state code book states if you have a baffled muffler, it is legal. I'm sure your muffler is baffled even if it is aftermarket. Noise (sound decibal) is not indicated, so it can be louder than stock and not be illegal. If sound decibal was a concern, there would be no harleys driving around right now, considering they all come stock louder than an F14 at full throttle.

if it's your first offense, you stand a batter thqan average chance of getting it dismissed, especially if you play the dumb role, and say something like it's always passed inspection, so you didn't know it was illegal. You only get to use the first offense thing once (the first time). good luck.

As a matter of fact the actual law is the complete opposite of what you just said. If it's louder than stock no matter what it's illegal.

Anyway, if it's your first ticket, DON'T just pay the fine! No offense to the person who told you to just pay, but that's awful advice. I made the same mistake almost three years ago, with a different type of ticket in Newport News ("running" a red light, when really I skidded through it because the road was wet, but whatever).
Generally, if you go to court on your first ticket, it will be thrown out. Unless you got a DUI or something along with it, of course. Definitely bring up the fact that it passed inspection and you've never been pulled over for it before. DON'T mention the thing about being pulled over in NN with a warning for speeding and the cop not saying anything about your exhaust. Just act like you have NEVER been pulled over for anything, warning or not.
That's just my "expert" police clerk advice. :) First offense + playing dumb should = the ticket being thrown out. Oh, and when you go to court, make sure you park in the HRT lot and not in the lot behind the courthouse (the courts/city hall/PD lot). It's permit parking only and you'll get a $10 ticket.
Good luck!
yeah thats what i was saying...the whole justification of that charge is that the muffler is supposed to MUFFLE the noise of the engine NOT increase it. nothing about DB levels or baffels or any crap like that.
" An exhaust system shall not be deemed to prevent excessive or unusual noise if it permits the escape of noise in excess of that permitted by the standard factory equipment exhaust system of private passenger motor vehicles or trucks of standard make. "
Thats a direct qoute from the law book. If you take it the way its writen, it means that the exhaust can't be louder then whats found on ANY car, not you specific car model. Does that mean we could compare the sound of the exhaust to that of one on a Mustang or Camaro or even a diesel truck? Seems fair considering the way its stated in the books.
