2007 should be a lot faster than that.
2006+ should be 40-43mph top speed if everything is A-OK with the bike. If it's running slower than that then the oil is probably overfilled (should be 550-600ml) or maybe it needs a new belt (or tire pressure, I suppose).
I have an 08 and it hits 44mph on flat ground when maxed out.
These things are so much fun.

it does closer to 40 plus theres always variables, wind, riders weight, up hill down hill, flat ground, i should have written 35 to 40 mph I hardley get the chance to ride it anymore since we moved here.

Yeah, true. I weigh like 160, if you weigh a lot more it's going to be slower. I just didn't want people thinking that it was slower than it was.
I commute 26 miles each way on mine in the summer. Nothing like slaloming hot dog carts on DC sidewalks at 30mph, lol.
