Anyone been screwed By EBAY? I Need Advice
Yeah sorry its so long, I even left some stuff out so it wouldnt be even longer. I figured i would give the people who sit on a computer all day something to read and keep occupied for a little while
ive dealt with stuff like this before, u have to bluff him and hope he doesnt call it basically...ussually after it sits in their minds a few moments they always give in..and escalation can always be canceled out ^^
ok listen up from a guy with experience...
I sold a laptop on ebay via paypal (an ebay company, a scam in and of itself) Everything was fine, the guy did a chargeback on his credit card a month later. PAYPAL THEN DEMANDED THAT I PAY THEM THE COST OF THE LAPTOP! Instead of recovering their money from the fraudulent chargeback, they figured it'd be easier to get it back from the average joe. Turns out that paypal is a money transfer service, not a credit service, so it won't affect my credit record, so i said screw it. left my balance at -450 and that was that. Of course...i had already taken the 450 out of paypal, so i have my money, he has his laptop and his money - paypal wanted me to pay for his fraud.
long story short - here's the cliffs notes of what i'd do - paypal and ebay protection is TOTAL BS. I've dealt with it many times...
Here's what you do right now. Print out a copy of every email that transpired between you two, exactly what he said...get a list in chronological order of what happened...call your credit card company, ask them to a chargeback for the transaction because of fraud...offer to fax them the documents of what transpired, explain your situation to them. You will get your money back, keep the product, and he'll be screwed. To cover yourself (not that you're doing anything wrong) but the fair thing to do to this creep (once you got the chargeback) tell him you'll send back his items if he sends you the money to pay for shipping... and give him an amount... take it to the post office and find out how much it is to ship, and tell him if he wants his stuff he has to pay you to ship it back since it was his error.
there you go. I hope you took time to read this, as this is the legal way to do it, and you'll screw him good.
remember - don't do it through paypal - do it through your credit card company or if you used a debit card - contact your bank and explain why it was fraud and do a chargeback...

and if you're worried about not ever having paypal again - for those times you absolutely need it - you CAN sign up for another account and they won't know - I did it and it's been going strong for 2 years now. haha

Well today paypal contacted me and said I have 2 options., (1) Keep what I recieved and shut up.(2) send him back the kit, and IF he has $3100 in his account i get a full refund, If he has anything less thats what i get from him, If he has nuthing paypal guarentees they will give me a maximum of $200. They no longer are willing to offer the $2,000 because they say his company is too new to them so they cant offer that much anymore. But after that they will take "action" and try to sue him for the rest of the money and depending on what they get they will refund to me. OR i can take legal actions myslef. THIS ALL SOUNDS LIKE BS...EBAY AND PAYPAL SUCK I have all the evidence against this guy and yet im getting screwed and i have to guess if he has money in his account and take a chance on loosong $3100 because he fucked up and admitted to not sending the parts and lying all in his emails. WOW im lost
I basically have 10 days to make a decision. So if anyone has a POS turbo that doesnt even work or needs a rebuild for cheap im looking to buy one, oh and a k series manifold also, and yes feel free to custom make it yourself as long as it weighs the same weight as the real thing, and if not fuck it I will send back a B-series manifold for all i care, If he can do it i guess i can too. This is the type of shit i will buy a plane ticket for and go see him in person and visit his so called shop, good thing i have a name and an adress.
