not necessarily... you can try and subpoena (sp?) her driving record and see if she has been ticketed in the past, for anything. Normally that probably wouldn't slide, but given that there are few witnesses, you have a good chance. The point here is to make her look like the irresponsible one, which will be tough given your age.

and i'd be surprised if your insurance will fight this for you.... because you're not being sued. But, if the lady does decide to sue you, if your family has an umbrella policy then they will provide you with a lawyer in the lawsuit to defend your side so they don't have to fork out any cash. But your insurance company isn't going to help you get out of court so you can keep your premiums low

got a lawyer 2 day. spic she came off the blvd. into the turn lane (witch is a censored light) didn't stop and came threw the drivers side. and her supposed witness was 3 cars back in a wrecker, so i think the wrecker driver just wanted to tow and didn't see anything, cause after i was facing on comin traffic and ppl were still comin threw the light. so if i ran a red light (but i didn't) the truck driver and everybody else ran a red light as well. also it was 445pm and she was tryin to get to the bank b4 it closed. and on the traffic report she told the cop she was going 45 threw her supposed "green light".

 

Wrong! If she had the green light, she has the right of way. If she proceeds into the intersection(on her green), someone runs the light and she runs into the side of them, it's not her fault.
With an independent witness saying you ran the light, she says you ran the light, you get the ticket. Since your witness is your friend, it doesn't have as much weight as an independent witness.

They do not have to tell you about witnesses. Yes there can be a discovery but you have to file a "Motion for Discovery". They don't just give it to you.

Now with regards to your witness. You can have your case continued until your friend gets out of boot camp.

Red.. Green.. purple.. i dont care what color the light is. You are resposable as a driver to look out for others as well. It's called defensive driving!! Pick up a Drivers Ed manuel and read about it.

well first off on the report, if it is true what you say. Her story won't match up. If she had been sitting at the light, and you ran the red, it'd be pretty hard for her to get up to 45, from a dead stop, in a turn. You may want to point that out to your lawyer and have an independant witness, say a drivers ed teacher, attempt that. If he can't get to that speed, then it'll discredit her to an extent. And how long did it take the tow truck to arrive on seen? If he was only 3 cars back then he should have been the first one there. If it took say more than 5 minutes to show up, he would be lying under oath and you'd have the ball in your court. You need to think about all the little shit that happened. Somewhere in there you may find some things that don't add up with your account of what happened and they'll have to prove it.
