Racing lead to fatal accident
Im one of Dave's closest friends and we have hung out on the weekends for the past 3 weeks straight. Brought him out to meet some of my friends and everyone loved him lots. He was a genuine guy and was always there for me. Its really sad to see him go and i didnt know till the next evening after the incident. All of our friends met up in front of hollywood video to share our respects. Its where Dave always calls us around 8-9 o clock on the week days to go get gas at Sunoco right next to it because it was the cheapest one in our area... We would talk, hang out, smoke cigarettes, share some laughter and that would always get our minds off the stressful days at work. It got to me really hard when the night before his incident, he treated me at a resturaunt and i found out about it while eating at the same place again. He was always passionate with everything he did. Automobiles, computers, work....everything you name it. He was selling his EVO so i could help him build a RB26 240 and we would work on it together. Next month as soon as I get back from Thailand, I was supposed to work with him and plan our own small I.T business. He had just finished ordering his business cards too. Dave had many big goals he wanted to accomplish and I believed in him. He would call me every single day to ask for suggestions. It sucks real bad since i cant make it to his funeral or wake. I just left yesterday and now im in Tokyo waiting for my connecting flight. We made plans to go with other friends this summer also. Rest in peace Dave.

Seriously all the people calling out the BMW which as by the video and pictures can almost tell that it had nothing to do with the accident itself. The BMW went straight continuing on 495 as per witnesses, the Evo went onto the off ramp and THEN the accident occurred.
I knew David as well and I am saddened by his loss. I hope everyone takes some time out to examine themselves and their street actions. I commented on the Evo forums reminding people that while these machines may seem easy to control we are not at anywhere near the level of professional drivers.

I agree it was probably an ignorant place to race. However I don't believe an innocent person should be tried for manslaughter or worse for an accident that did not involve direct contact between the parties.
My condolences to David's family and friends.
^ Sorry but the act of racing is what caused the parties to obtain excessive speed. Without that speed the accident would not have happened.
That's why you shouldn't street race... you could do nothing wrong, but the person you're racing flys off the road and dies for whatever reason. You're responsible because you were racing.

Both parties made the choice to willingly race, knowing the risks involved. The driver of the EVO took an exit ramp going too fast and lost control. Its unfortunate the accident happened, but its not the fault of the BMW driver. Had the BMW driver swerved and forced the EVO driver to take the exit ramp thats another story.
But then again this is VA, they're always looking to make an example of people with moddified cars.

Not true... most every state has very strict racing laws. You enter into a speed contest and you're now guilty no matter what the end results.

Could have came back to check up on him etc instead of taking off.
