if your going to drink at all and you plan on driving, the max should be 1 an hour for pretty much anybody. That BAC website is actually an interesting way of looking at it, but shouldn't be used as an allowance chart. you're just asking for it, especially when the cop to civilian ratio on the roads at 2am are 5 civ's to 1 cop.

You are not required to take any those test, not even the breathalizer. That is unless they have arrested you. If you are arrested and refuse then they can suspend your liscense and all kinds of other stuff.

In VA, if you refuse the breathalizer, you are arrested for DUI then your BAC is tested at the station.
