Nobody keeps things in their wallet that they don't plan on using.

Why do you carry your license? Because you may need to use it.

Why do you carry your credit card? Because you may need to use it.

Why do you carry a rental card for a movie store? Because you may need to use it.

Wallets are for carrying things you may need to use only... they aren't personal gadget displays.

 

 

Part One: Great assumption, but lawyers are all about gaining the benefit of the doubt keep in mind - your point is reasonable, but holds no weight, sorry guy.

Part Two: YZRacer is not a snotty kid, meet him, you will see. He has plenty going for him, enough to prevent him from being snotty, that's for sure.

Part Three: I dont see where he is suffering much; he is worried about the situation, but beyond that what's there to suffer? Please don't tell me you actually believe he's going to get slammed for this ticket. Mate money with a lawyer = very little suffering.

That's a good point, but I think it has been forgotten that our court systems are not based on "good points" but rather firm facts. Did he use the fake ID? Nope, he was only possessing it, regardless if it were in his wallet or not. Who on here cares what his true intent was? No one - that's is only between he and the judge.

Good points paint intentions. Intentions are a very big part of the court. Possession of a fake ID is intent to use or sale it. Just like cocaine, heroin, or anything else... if you have it on you, you're going to use it or sell it... you aren't carrying because someone gave it to you years ago and you thought it'd be smart to carry it around.

P.S. The law understands this, which is why it states possession is illegal as a misdemeanor, but the use to purchase a firearm is a felony.

I agree. But with your examples above, you have to have X amount of each substance to be accused of having intent to sell - which is a whole different issue when dealing with drugs, so the analogy doesn't match up entirely.

A good lawyer can get you out of juvenile stuff such as this, I'm not saying YZRacer is in the clear, as far as not having to do some community service or simple BS like that, i'm just saying that the claims of him doing time in jail or having severe consequences are far-fetched.

Is this being handled in a traffic court? I assume so. In most cases, I have found traffic courts to deal with such scenarios as Infractions rather than Misdemeanors. So don't sweat it, really.

Keep in mind, the things I listed several pages prior are the maximum penalties you can receive as a result of your possession...If you were to get a lawyer involved, or have a gracious judge, there is a great chance that you will see even less severe consequences. Again I think you'll just get some community service time - no big deal, a lot of people go through that stuff.
