F*cking hang up the phone and drive. Bad to hear of someone getting hurt, but damn. She was talking on the phone and was surprised that she was in an accident? Who cares who hit whom. Accident could have been easily avoided with defensive driving. I *never* hit the brakes without looking first in the rearview. Something road course drivers learn in the pits.
Hope you feel better and stuff. Get the maximum prescription amount of the good muscle relaxants.

rich that was uncalled for. she did the LEGAL thing as did the car in front of her and slowed down as the car in front was turning. The car behind her never slowed. The illegal pass was made by car #1. please read before you open your mouth and insert your foot.

Phil: Have Jessica contact an attorney and get a copy of the police report. Following too closely (misdemeanor) is the blanket offense. Have the attorney press for Reckless Driving under the new aggressive driving statutes. Section 46.2-880 "Tables of speed and stopping distances." dictate how far back the ramming vehicle needed to be. For 45 mph, it's a whopping 96' required. That helps for reckless charges since the modified definitions state that speed does not need to be a factor. The agressive driving charge is an empty buzzword with a definition that helps win damages in jury cases.
She will have to go to civil court for damages not covered by insurance, like her deductible, and lost pay, healthcare deductibles, etc. She may also want to call insurance company for a rate quote if it goes up and ask for the 5 year rate adjustment in damages.
