possession of alcohol?
does anyone know the law on "possession of unopened alcohol under 21 in virginia"???
i didnt get a ticket but i have to go to court
i had a beer in my cell pocket on my shorts
heres what happend
i was in the drive way at a friends house the night before turkey day
and 2 cops pulled up and asked me "are you 21 son"
i told them i was 20
they asked me "whats that a root beer"
i said no sir
he didnt ask me after that what it was and i didnt tell him
pulled out my id they ran my stuff and said "this is not a ticket its a summons"
i said ok i told them to have a nice night and to have a good turkey day
put my hand out to shake his hand and he just walked away
if anyone has any info i would be most happy to read it

Had the same thing about two years ago. I went to court without a lawyer and got a slap on the wrist + community service and court cost. Unless you have lots of priors you're fine.

you can easily get out of this if you get a lawyer. I'd honestly call one and ask him for advice, he'll probably say you should hire him because this is how he's going to fight it and you'll def. get off. Then just go to court yourself and say what he told you, you should be good.

Private property only applies if you are in a fenced in yard. If you have no fence around your front yard, you are "technically" in public view. I know it's stupid but my neighbor across the street from me called the cops because me and my bro were drinking on the front porch. The cop explained it to me in detail. I did not get in any trouble. I was told to take it inside or outback.
"Persons under the age of 21 posessing alcohol are guilty of a Class 1 misdemeanor and, upon conviction, face a fine of up to $2,500 and/or a year in jail and/or fifty hours of community service, and can lose their driver's license for up to a year."
