Default Tint Question in Fairfax County?!

My Brother got pulled over this morning and recieved a ticket for the Tint on his car Infiniti
G35. When the cop measured the tint it read 39%. I know the Legal limit in Virginia is 50%, but when he purchased the car from the Dealership it came stock with that tint. The car was purchased in 2003 with the Tint straight from the dealership. Is there a way to argue this case or is it just a lost cause in Fairfax County.

is the tint on his film or is the window itself actually tinted? If its just film tint i dont think it'll fly.

^ Yeah he might as well just pay the ticket. If he had just recently purchased the car he could take it back to the dealer and have them pay to have it removed or maybe even pay for the ticket. We just remove it for our customers. If it's not the tint film and the window is actually tinted(never seen or heard of this before, except on SUV's or vans and that's just the rear) then he wouldn't be able to give you a ticket and you could fight that because it's factory installed. That's like getting a ticket for HID's that were factory installed.

I had 35% all around on my black EK civic and I have 35% all around on my SRT4 and haven't gotten hassled it by any county. I did after a year of having the tint on my civic got pulled over on 66 in Prince William County by a state trooper that measured it and it measured out to like 34% but he didn't give me a ticket because I had gotten an exhaust ticket the week before, so if I was your brother I would just pay for the ticket, it's the easiest way instead of paying to get it taken off and taking it off altogether. My friends and I were talking to a PWC cop and he told us that the legal limit for tint on the front driver and passenger windows is 35% and you can tine the back windows as dark as you want, from what I've heard, I might be wrong.

The cops dont even know the legal limit for tint. It all depends on who you talk to you. I've been told by several state troopers the the limit for the front two windows is 50% and the rears are 35%. However I've also been told it's 35% all the way around. I think by keeping us guessing it's there way of being able to pull just about any tinted car over.

Only SUV's comes with factory tint 35% in the rear. Sedans and Coupes are usually light tinted glass. If it reads 39% then thats not factory. I used to own a G35 and its definitely no where near 39% :P
