Ticket for Failure To Maintain Control of Vehicle.... anyone in Chesterfield Co?
So tire popped, ran on a median, i hit a sign.
The officer told me he wouldn't give me a Reckless driving ticket, he writes on the ticket 46.2-853 "failure to maintain control of vehicle"..
So I call the court clerk the next day and she says it is classified as a Reckless ticket, and I need to appear in court..
Anyone know how this will go down? What I can do? What I should do? I'd rather not get a lawyer because I can speak for myself. The officer and I chatted for hours waiting for a tow truck, and he said If its been less than 5-years since I've taken driving school then I can't request it... Should i request driving school anyways?
Any insight would be helpful, especially from any Chesterfield PO.

Gonna depend on what you were doing when the tire popped and if you have witnesses. If you were driving along obeying all rules of the road and it popped I would think you could argue equipment failure caused you to lose control, not anything you were doing wrong. But I'm not a lawyer.
If you don't have witnesses that can appear in court with you, it is usually just your word against the police officer's. If there is going to be a chance that it will be reckless, I would suggest getting a lawyer. It will probably at least be a lower offense if not dropped.

Well i called the officer he said "hey bud Im just gunna tell the judge you misjudged a turn, hit a curb and then a sign"
so this would be alright possibly..

Get a lawyer. Think about the fines, court costs, and the hike of your car insurance every month for the next five years with a reckless ticket on your driving record; and then add it all up.
I'm sure it's way more than getting a traffic lawyer.
if that's the truth then the cop should agree and tell the judge that and it will be chocked up to faulty equipment which carries no points and is a much cheaper fine, if you are lying in anyway the judge and cop will see throught it, then you will need a lawyer to tell the story for you... and if you think the cop hates hondas, then get a lawyer, if u want to be on the safe side, get a lawyer...
