If you are asking whether or not police can pull/cite you for your tint specifically then the answer is yes. At least in Newport News

Re: window tint: primary or secondary violation?
definitely primary... I used to get pulled for it all the time.
I'm working on a 'Sun-shading waiver' through the DMV to allow darker tint.
Its a form that you fill out, have signed by your Dr/optometrist/ophthalmologist/RN, and fax to DMV. They approve/deny (most likely approve).
Then you can go 35% on all of your windows, 70% on the windshield.
... This way you dont spend $200 on a nice, VA legal tint job that looks like ass...

Re: window tint: primary or secondary violation?
35% still looks like ass however.
I had 15% all around for a while and got pulled too many times. I gave up and I've removed the fronts and left the rears/hatch tint. All is well for now.
If you stagger 15% in rear and 35% in front, it'll put up the illusion you have the legal 35% rear and 50% front set up. As long as the cop can see your face, your chances will be significantly lower.

Re: window tint: primary or secondary violation?
Didnt say it was fool proof. Just a bit less obvious. I'm sure NOVA cops are a bit more strict than down here. Whenever I got pulled for tint it was on I-81 going to and from blacksburg.
