A properly installed Intake will not affect Emissions in any way. Unless there is a law I'm missing, He can fight this and win easily!!!! We have rights!!!

he told my friend that the officer did site him some law, but i never heard such a bs law.. i think he was telling him the defective equipment law
the easiest thing for the guy to do is what i stated before...put the stock airbox in take a pic, show it to the judge and have a good day. Thats straight from a police officer.

There is no way in hell I'd do this if my intake was installed and functioning properly. Are you giving tickets for intakes?
Have the guy check the ticket for the law number he broke. All tickets have to have the law code for the law you broke. Then he can look it up and see what it states. He could have had a 50 states legal AEM intake and could get off.

Those are Carb(Smog) legal for all 50 states mainly Cali. That doesnt mean an Emissions station machine wont fail your car. If you've altered the emissions system then they can give you a ticket, i'm not 100% sure but i think changing your intake is altering it. Thats like saying you have a Apexi 50-state legal exhaust...that doesnt matter it's aftermarket and produces a different sound note, your gonna get a ticket if it's not OEM. I can go put a Ford Motorsports Exhaust on and get away with it being louder since it's stamped Ford Motor Co.
He gave verbal consent. Legal search at that point. Same thing if the cop asks you if you'd mind popping the trunk or asking if he can look around in your car (other than what's in plain view). Without reasonable suspicion, there is no cause to search.
Even though I don't keep contraband or weapons in my car, I never give the police permission to search my vehicle. However, if the police want to search your car they will. I had an incident where I was stopped and the police asked to search my car. I said no (I was under 21 and had beer in my car). The cop made up a BS excuse and searched my car anyway. When I went to court the charges were dropped due to illegal search and seizure.
To search a vehicle the police technically need probabale cause, however there are some technicalities If the police have reasonable suspicion they can hold for a reasonable amount of time for a drug dog to do a quick sweep around the car. If the dog detects nothing, you are free to go. Should the dog bark they can search your car and they can charge you with anything they find in the car. A good lawyer should be able to get you out of any charges should that happen.
As far as a ticket for intake, I've never heard of such a thing. Unless it violates emissions law, you should not have recieved a ticket for an intake. The cops cannot make up laws as they see fit. I would ask the cop to show me in the code of VA where it says intakes are illegal.
