I agree with some of them, and don't get me wrong here, I am not an advocate of driving like a "dipshit" as another member so eloquently put it. I am however totally against the seemingly sneeky way our law makers and governor got it over on us with out our knowledge, and again shame on me for not having the time to sit and read every bill currently being debated in the GA or sitting on the Gov's desk for his siggy. The issue to me is how it got enacted. There was no advanced notice by anyone in the media I am aware of. There were no outraged citzens' groups....no nothing. I mean, come on....do you really think that a porno movie being able to be seen by a passing car merits a 900 dollar fine? Or accidentally leaving your wallet at home, which ALL of us have done from time to time......does this warrant a 900 dollar fine? In my opinion these fines and some others are excessive. There is a prohibition on excessive fines in the Va. Constitution. It is in Article 1, Section 9:

Section 9. Prohibition of excessive bail and fines, cruel and unusual punishment, suspension of habeas corpus, bills of attainder, and ex post facto laws.
That excessive bail ought not to be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted; that the privilege of the writ of habeas corpus shall not be suspended unless when, in cases of invasion or rebellion, the public safety may require; and that the General Assembly shall not pass any bill of attainder, or any ex post facto law.



The only problem here is that Excessive is not defined, and just like the exaust laws, it is subjective, and as such it is left up to the person interpereting the law as to what is excessive and what is not. Not only that, but the law is discriminatory as well. It discriminates against Va. residents because out of state drivers cannot by this law be assessed the same fine as Va drivers. How in the hell did they figure that one out? That means all of the military stationed here who are not Va residents get a pass if they are bad drivers but we do not. They are smoking some good shit in Richmond fo sho! The citizens of this state have been fucked by their GA and governor, plain and simple.

They got around the excessive fines because these are not fines, they are administrative assessments. These administrative assessments are attached to the drivers license by the DMV, hence the reason that non-residents are not assessed.

Edit: If you are playing a porno in your car that can be viewed by my kids, you should get the additional penalty. As far as forgetting your wallet, that charge can be dropped by the Clerk of Courts simply by showing them your license...which means that you would not get assessed the additional penalty.

Interesting.....still, though it is not right.

And I would not want my grand kids to see any porn in another's car on the road either, but I still think the 900 "Administrative Assessment" is excessive.

I think whatever a person wants to do or display inside or outside of their vehicle as long as it does not bring physical harm to anyone should be their business. Don't like it, don't look.

I take my vehicle as much personal/private space as the inside of my house and am very territorial about it.

I personally don't play porn inside my vehicle, but I am a firm believer my views should not impact someone elses rights.

Just something to remember, your rights end when they violate the rights of others.

What someone does in the privacy of their own home is protected because it is not in the view of the public. Performing those same acts in their front yard, while still being on their own property, violates the rights of others to not have to see those acts. Your car falls into the same category as your front yard, which is why you can be charged with drunk in public while riding in a vehicle or in your own front yard.

I will support someone wanting to view porn in their own vehicle, as long as I or my children are not able to see a donkey fucking a transvestite as we walk by.

I have the same feelings, but I can control what my children watch in my house. I can't exactly turn off the porno that is playing in the car in front of us while sitting in traffic.

ok what if you have a turn signal bulb that just went out... and you are driving like a PERFECT VA CITIZEN you say are and then a cop pulls you over because he didn't see you use the signal... now you have a $1000+ fine and God knows what other bullshit fine you'll be charged with.
Are you going to be a PERFECT CITIZEN and just bend over and take it up the ass because you agreed with these fines?? or like many other people on this site you can just throw away $1000 when ever you feel like i?t?

That one is simple. Since you know that you used your signal, have the cop check your signals while he is there. It is unlikely that he will write a failure to signal citation because it won't stand up in court. If he is a dick and still writes the ticket, you replace the bulb and show up at court with the receipt and a witness. The judge will have no choice but to reduce the charge from failure to signal to improper equipment, maybe even dismiss the charge entirely. Now you have nothing to pay for, except maybe to buy your buddy a beer.

Pornographic material can be very damaging to kids, two guys kissing, not so much.

If you think exposing CHILDREN to pornographic material is ok, get your fucking head checked.
