Uh.... how about you tell me what happened. If you mean you weren't issued a ticket, then that doesn't mean you weren't at fault. I.e. you hydroplane and hit a guardrail.... you may not get cited for speeding or reckless driving, but it's still an at fault collision claim and for that your rates will go up and should go up.

Cops will do whatever they can to get out of paperowrk.... i.e. they'll put estimated damages < $500 all the time when it's way more to fix becaue that's one less form they have to fill out.

OP needs to give us some more details for me to advise.... plus I haven't worked as an insuance adjuster since 2005.... fuck... almost 5 years now!

Can you sue the city or county since it was their fault? I seriously had pretty much the same thing happen about 5 years ago. I didn't get a ticket and the officer said the same thing, it was pretty much due to the road not being properly maintained. Less than an hour after they pulled my car out, a minivan did the same thing I did and got totalled. 2 hours later they had VDOT fixing the road.

I think you should go after the city or county that it happened in. I went with insurance and lost my good driver discount and I'm pretty sure it caused my rates to go up. (thank fucking god I've got my good drivers discount back, no way I'd have bought the STi without a perfect record, the insurance is crazy already)

Ok I just saw the story.... you were "not at fault" meaning the offier didn't cite you for a traffic violation. However, in insurance terms you were... you were driving and you got in a wreck. It wasn't an act of nature or anything that would fall under your comprehensive coverage. In this case it's 100% normal for the insurance co to charge you with an at fault collision claim. The police and insurance are not one in the same....

cobra- the road was closed off for a week after the big snowstorm then about a week after it reopened I drove on it went around a blind corner going about 25 mph and hit the ice and water and hydroplaned and hit a small hill sideways then backwards. only did about $1,800 in damage total. I understand the police didn't give me a ticket and that does not mean that I was not at fault. However the officer told me that because this road was considered like high risk or something and was supposed to be monitored and hadn't that it was VA's fault for not maintaining it. I have never been in an accident before or even gotten a ticket and my insurance is raising my premium by almost $1,000 a year for it. When I talked to my insurance agent the officer told her that it was not my fault and she assured me my rates would not go up because of it.

This is true. I had some faggot pull some retarded move in front of me that caused an accident. It was very hard to judge who would be at faullt, but I felt the other guy was, he said he was, and I had a guy tell me he saw the whole thing and would be a witness for my side. Cops asked us how much damage we each had. He said 200ish, I said maybe $500 and the cop said since it was less than $1000 or something that he wasn't supposed to write a report.

Got home and called my insurance to make the claim and they refused to do anything without a police report. They said the other guys insurance could turn it around and sue me since there was no report.

Lesson learned, if you ever have a small one like that, say $3000 or more, you WILL get a report. I'm pretty sure it was $1000 and over.

Insurance agents are mostly sales people... they often don't know the intimate details of policy and claims. You could try to sue the city, but that's hard to do. Taken at face value your claim/accident falls under at fault collision in the eyes of your insurance policy. As a result they can raise rates. Some companies advertise "accident forgivenss" etc. but that's dependant on your company and your policy.

All you can do is bark up the chain and see if you can get them to chagne it... many times they can and will bend the rules if it's a grey area or the customer is a long-time policy holder w/o any prior claims.

Otherwise, it's time for you to go insurance shopping.... because you weren't cited for an accident or moving violation the incident won't show on your MVR so you don't have to tell the perspective new company about it.

I'm pretty sure they jerked your chain. In MD police won't even respond to a scene of the accident unless there is a need to close the road or call an ambulance. This would mean that except in the largest of accidents claims are impossible in MD.

If the state didn't pay for it, or if the insurance paid for it and didn't try to recoup the money from the state, your rates will go up. The fact is that an insurance payout was made, and unless the insurance company gets their money back from someone, your rates will go up. That's how insurance works usually, with some exceptions obviously.

I'm not sure why a police officer would say something like that anyway..
