I've been through settlement. It doesn't go as well as you'd hope. I got nailed by a guy going 50 through a red light. Admitted fault several times to the cops and me and my insurance company.
His insurance company still went to court and then tried to counter-sue me. After about a year or so of fighting it I was too broke to continue paying for my own rehab and legal fees so I took their settlement.
Shit's fucked.

I had bruised ribs and my spleen was enlarged (which is probably just due to me being so tall?), but regardless we blamed it on the accident.
Also, in VA there is some loophole that if you pay your medical bills the insurance company must reimburse you for your medical bills twice. So you get a 200% reimbursement.
It's something like that, my dad found it. I don't remember.
