thats why I hate STAUNTON, everyone there is cop and how they police isn't right. And there is hardly no industry so no revenue, so someone had the smart ideal of making all the towns money off of bogus tickets. To me its a loophole in our police, and this is comming from someone studying criminal justice.

Not true.

And if it was me I wouldn't have done shit to the car. I would've called a lawyer immediately. That cop would've at least reimbursed me for the tow.

yea sounds like someone got owned because they didn't know their rights...YOU ARE allowed to see any test they perform on your car to determine legalities..and the drug search dog falls under reasonable cause...if you ask what the reasonable cause is they usually will not perform the search because they know they are dealing with someone who knows their rights

That is not a fix it ticket, there is quite a few valid reasons for pulling those tags. First is obviuosly they are expired, you have no proof on you at the time of the stop that they were still valid. Second you may not be elligible for renewal, he also has no way of knowing this, you may not have paid your taxes, unpaid traffic violations, no insurance, etc...... Third stolen tags are a hot item currently, especially amongst illegals. Just because it matches the old registration does not mean they belong on that car any longer. In fact old tags on a vehicle happens regularly. There was thread about this not too long ago, car was sold with tags on it, and the old owner incurred many tickets for violations.
Bottom line is he was well within his responsibilities to do what he did, As far as the drug search, you complied so he did his job. You could have said no, but I can tell you this, expired tags is reasonable cause to get a court order to search a vehicle. He would have gotten it, he would have also impounded your vehicle, more costs involved in that. You got off with a slap because you were compliant, if you had gone the defiant route you would have incurred more costs, and loss of time fixing the mess for being an asshole.

He would have gotten that reasonable cause broken off in his ass, expired tags is more than enough reasonable cause by State and Federal laws. He also does not have to show you any test, and can direct you to stay in the vehicle at all times. You people think you know your rights, but you do not know the laws. You also are not aware of the serious drug trafficking that occurs through the state of Virginia.

Hmmm ... I dunno . Expired tags and stolen tags are gonna come up differently . If they were expired, they would still be registered to that vehicle and that owner . I'm an ass so I would have made them get a warrant and I have pretty high doubts that a magistrate would offer one based on expired tags previously registered to the driver and lowered suspension . I've been pulled for both and was warned but was also shown in detail where the measurement was taken and where I had to be to make it legal . The cop that pulled me was a dick about suspension ( it was supposedly his thing ) and he told me that it's difficult to measure on newer cars due to everything being covered by plastic but he has his ways ?! haha . And as for tags > I got pulled at the beach in a Jeep with a soft top and it was up > also had an insulted liner and it covered the windows so you couldn't see in . The cop was shining his light inside my Jeep trying to see what was inside and I asked him to stop and if he had business with what was inside he better have his papers in order ( and I was a complete ass ) . He backed off and let me go but of course ticketed my for the tags ( which I instantly renewed and they dropped the tik ) .

Also .... you are correct that WE do not know all the laws BUT >> police officers do not know all the laws and interpretations either . If they did , we wouldn't need a judicial system . They DO have a better knowledge of it than most of the public but I would say it's pretty close to impossible to know every law and understand every aspect of it .

If he his registration was up to date it would show when the cop ran his tags. So that all goes out the window.

^^^ you obviously have no idea what the laws in virginia are. He CANNOT measure your car without you seeing him do so. He is supposed to direct you out of the car, ask you if it is ok, Then proceed to measure to the bumper SUPPORT and cannot just guess the whereabouts of where it should be. He has to see the support and measure it to a T.. The tags show up when he pulls the tags like they ALWAYS do before they get out of their car. If they were legit it would tell him in his comp and tell him what car they belong on.

Next time this happens before you leave tell him you would like to speak to his supervisor.

I did this and I works.

I was pulled in my white del sol and he told me it was too low measuring from where he THOUGHT the bumper support was. I called him on it and he got smart with me. I asked to speak to his superior and he actually had to come out and perform the test himself. I had to pull the buper off the car completely so he could the the support and then he measured and I passed.

so before you act tough know your shit..
