What? No.

You're innocent until proven guilty. That's why the cop doesn't give you a ticket, they give you a summons.

Take a driver improvement course - do not have them turn it into the DMV unless the judge orders you to take the course or gives you the reckless, this way if you need it again in the future you can get still use it.

If you can get the speedometer tested at the same place the cops do theirs do it - if it is off get it fixed and then go back to get tested again

YOU CANNOT GET PROBATION anymore for speeding or reckless so you need to either have the case dismissed/ reduced to regular speeding which you were off by 1 mph.. you will have to pay something, but if you get reckless its a max 2500 dollar fine + $950 for the civil fees + they can suspend your driving privelages ((which you can most likely get changed to allow for work)) and if you have a bad record or piss the judge off you can go to jail.

If you go without a lawyer you will most likely get the reckless.

Also do not dress like an idiot, wear some slacks long sleeve shirt tucked in and a tie... jeans and a baggy sports shirt are stupid. You will be in front of the judge for at most less than 5 mins - Appearance counts!! Call the judge Sir/Mam or Your Honor... do not call him dude or buddy like some of the idiots I watched recieve the heaviest fines possilbe.
apparantly fullsize fun is one of those idiots you're talking about, haha.

Your stupid I was in Court LAST FRIDAY!!!! and I got my reckless dropped to a regular speeding ticket without the civil fines!

The only reason it wasnt totally dropped was because I was doing 27 over the speed limit...so even with my Speedo being 10 off I was still speeding.
If It would of been brought back under the speed limit the judge said he would of totally dismissed the charges.

The only thing they cannot do now is Probation.

They can still do probation, but it won't affect the civil penalty.

Judges still have a lot of power. The only thing that they can't do is reduce the amount of the civil penalty if you are CONVICTED of one of the crimes listed in the bill. They can still reduce the charge which gets you around the civil penalty, but they can also convict you of the original charge and decide the amount of the fine (up to $2500), the amount of jail time (up to 1 year), and suspend your license.

No offense, but when a judge says to the entire group of people gathered in court before he even starts hearing cases. That they have been "ordered by the state legislature that according to the virginia laws they are not authorized to give probation for speeding, reckless, running red lights, and stop signs" then Im going to take a Judges word over yours.

There is still some things that are authorized just Probation but the ones I listed are not and he did not go into those.

The other stuff you mentioned just repeated what I put in my original post, but thanks.

The probation thing must be very recent (since you were in court last Fri) because my brother just got probation for speeding back in Aug.

The other stuff was for the poster that was arguing with you.

Good post and correct me if I'm wrong, but anything over 80 in VA is reckless, not just 20 over.

Otherwise, good post very informative :]
