It doesn't matter why he had it. The law says that possession is illegal, because possession of, just like drugs, is intent to do something illegal with it, whether he planned to use and/or sell it. When it's illegal to possess something, it's usually with good reason, being that, the only thing you can do with said "thing" is something illegal.

It doesn't matter if his friend gave it to him, his mom gave it to him, or if the fuckin pope gave it to him... What does matter is that he was caught in possession of it and possession is clearly stated as being ILLEGAL, and as mentioned, the reason for possession being illegal, is that it's only purpose is to be used in another illegal manner.

While this is the cut and dry truth of what happened, what will happen in the courtroom esp. if he has legal assistance with him will be a different story. Example? OJ Simpson. Need I say more?

If it were this easy lawyers wouldnt have a job.

Cut and dry... without political bullshit or consideration of how the judges day is going. Too many factors to tell, but in my opinion... he'll get off pretty easily. The route I'd take:

1: Admit guilt, you're going to be found guilty anyway. You were caught red-handed.
2: Recognize that you made an error, and ask for the judges mercy.

Bring up the history of no priors, but leave the bullshit fabricated story about it only being in your wallet because your friend gave it to you out. Best way to piss off a judge? Lie to him.

I totally agree, possession is illegal, that is a fact.

But in the courtroom, like luv2turn said, it's a whole different story.

He just needs to be nice, polite, honest, and things will go well for him.

A short talk with the judge or officer prior to the case will go a long ways. Family lawyers are a +1...

haha, I don't know where you guys got the idea of me being rich, but I am working with a Lawyer right now that has represented a bunch of Car Club guys. Appreciate the responses guys.
