Has anyone bought anything from CarMax ?
Just curious, but what is this CarMax scam you mentioned? Sounds to me like the techs they have just couldn't find the problem. Something obvious to the person driving the car everyday may not be so obvious to someone who has never driven the car. The same thing happens at other dealers under factory warranty. If they can't verify the symptom that you described then they don't do any work because they won't get paid.
I'm also wondering what your case is based on. Sounds like CarMax is taking care of everything and you won't have to pay anything. Sorry guy, but you are making CarMax look pretty good since they are going out of their way to take care of you.

Also the strut issue is a known issue with the STI's. It is just that those techs dont specialize with Subaru so they didnt know what to look for for the signs.
If CarMax really submitted a fraudulent bill, don't you think that the warranty co would be coming after them? It just doesn't make sense to deny a claim because a part was replaced once before.
Either way, this guy has no case...CarMax is covering the repairs so he is not going to be out any money. CarMax might throw him a bone ($250 off next purchase) just to get rid of him, but he'll never see anything in court.
two struts was in four differ times , each time the tech said he didn't hear anything , the first time he took it for a test drive he rolled the windows all the way down and turned the a/c on full , now how you going to even try to listen to it with all that noise , 5th time it went in was to replace the drivers side rear and had asked them to bring me the strut while i was in the service writers office , they did and i fully compressed it all the way by hand . second strut was in 4 times , 5th time still can't hear it they said wait till it gets louder and bring it back ( there just killing the warranty with miles ) good thing it wasn't in for a knock lol . brought it back the tech took it out for a spin and came back said he couldn't hear it so i took the serice manager out on a drive before we even had time to leave the parking lot he heard it just fine . thats when they charged the warranty company for two struts when they only did one .and didn't return the other . or kept the money or whatever or probably sold it . lol . so when it came time to replace this one 4x4 specialist called the warranty company just to find out it was declined by them since it was replaced in oct 06 well only one . but the warranty company said two . o well guess you just don't see the big picture .

Why does it matter how many struts were replaced the first time? The strut is bad now, the warranty is still in effect, so the warranty co has an obligation to replace it. They are just playing hardball like normal.

So it is ok for me to charge you for 2 items when I really installed 1? That is why they arent honoring it this time around. Carmax was dishonest about the first repair claim.

The warranty co is violating the terms of the contract that they have with the customer by not honoring the warranty. If the warranty co determines that there has been fraud, it's not the warranty holder that they get their money from, it's the crooked shop. If CarMax did not cover the bill, the warranty co would be who you take to court to collect money from.
When you take your car in for warranty work and they make false claims(why on earth would anyone be that stupid when they may have to send the failed parts back) then there is a case and proves someone is very dishonest. It also gives the customer a hard time because if they need more warranty work, chances are that company will deny the claim because of the past issues of carmax being dishonest with the repairs and claims. Not taking care of the customer if you ask me.
CarMax is covering their ass by taking care of everything right now. If they take care of everything, then there is no case right now. I don't know why this guy keeps taking the car to CarMax for repair after they have told him they couldn't find the problem, but that's a different story.

You are missing the entire point. The shop made a false warranty claim AFTER a repair was done. The warranty company caught this. That right there legally free's the warranty company of any responsability in payment. They may have flat out denied the claim and in some cases doesnt allow a shop to resubmit it with the corrections. With every other warranty company there are legal clauses that protect that Company from things like this. A warranty claim is just that, but if you abuse it and make a false claim, they do not have to pay the repair. This happens with all companies and the dealership eats the repair.
Same goes for car insurance. You have a shop try and help you out and cut corners and they fudge the claim. However, the car insurance company catches this, you are saying they still have to honor it and pay to have the car fixed? I am willing to say they wont pay a thing.
Another thing to think about, this could also be a parts warranty which they might not cover in the customers plan, so they dont have to cover it a second time if that is the case. All depends on their plan and the warranty companies coverage policy.
Not so fast. They are not violating their contract terms. The warranty company doesnt have to honor a claim if it is Submitted wrong. They can send it back to the dealer giving them a chance to make corrections and resubmit it for payment. They also can deny the claim and Carmax has to eat it. They havent violated their contract. It is up to the repair shop to submit everything correctly. When doing a warranty claim you have to make sure everything is correct and submitted correctly.
They are doing it probably because they screwed up the claim before and realize their warranty company wont cover the second repair because they submitted a false claim before trying to get more money from the company, which gives the warranty company every right to refuse a claim.
Sure, show me the 2 items that you replaced and when they fail, you will be paying for someone else to replace them after it is discovered. Exactly what is happening here, which is why there is no grounds for court.

That's between the warranty co and the shop to settle. By denying claims, the warranty co is violating the contract with the customer...it is the warranty company that you take to court for denying claims, not the shop.
